ETKS Partner William T. Easton Wins An Appeal Reversing a Guilty Verdict of Murder in the 2nd Degree.
ETKS Partner William T. Easton secured the dismissal of an indictment for a client who was convicted of murder in the second degree based on a theory of accessorial liability and sentenced to a prison term of 21 years to life in 2022. Before the 4th Department of the Appellate Division, Mr. Easton contended that the guilty verdict was not supported by legally sufficient evidence to establish that his client was aware of, and shared, the intent to kill. The Appellate Division agreed with the claim, reversed the judgment, and ordered an immediate release of Mr. Easton’s client while preventing prosecution from retrying the case. Achieving a reversal in the Appellate Division reflects a dedication to advocacy and great legal expertise. Congratulations to Bill on this tremendous accomplishment!
