ETKS Partner Donald M. Thompson Wins An Appeal Reversing a Guilty Verdict of Murder in the 2nd Degree.

ETKS Partner Donald M. Thompson obtained a new trial for a client that was convicted of murder in the second degree and sentenced to a prison term of 25 years to life in 2019. Mr. Thompson contended, to the 3rd department of the Appellate Division, that the trial court failed to give a defense of justification instruction to the jury by affirming that there was reasonable evidence for the jury to conclude that the defendant’s actions were justified. Ultimately, the Appellate Division agreed with the claim and warranted a new trial. Obtaining a reversal in the Appellate Division signifies exceptional advocacy and great legal skill.
